Regarding providing special facilities in assessment to students with disabilities as per the provisions of the Rights of Persons with Disabilities Act-2016

Reference: (1) The Right of persons with disabilities Act 2016 {No:49 of 2016}
(2) Letter No.: GCERTC&7201923047-84 Dated. 15/06/2019

In accordance with the above subject and reference, it is hereby notified that as per the provisions of Section 498 of the Rights of Persons with Disabilities Act, 2016 (2018), if the disabled students of primary schools produce a disability certificate issued by the competent authority, special facilities shall be provided to them as per their need and reasonableness. In accordance with the rules framed by the Health Department regarding what is to be considered as disability or learning disability, the following special facilities shall be provided to the disabled with learning disability by producing a certificate from the competent authority. For the purpose of this circular, disabled means completely blind, low vision, deafblind, hearing impaired, speech impaired, orthopedic, mental illness, specific learning disability (Dyslexia. Dysgraphia, Dyscalculia, Dyspraxia and_Developmental aphasia), Cerebral Palsy (CP), autism, multiple disabilities, cured blood clots, stunting, mental retardation, muscular dystrophy, chronic neurological, Multiple sclerosis, Thalassemia, Haemophilia, Sickle cell disease, acid attack victim, Parkinson's disease, etc., as per the provisions of the Rights of Persons with Disabilities Act, 2016 (498 of 2018) and as per the recommendations of the National Education Policy 2020 (Part-1 Chapter 6) and NCFSE-023 (Part-B Chapter-4), the following shall be implemented in primary schools.

Relaxation in examination time

Students with disabilities will be entitled to an additional time of half an hour (30 minutes) in all written examinations taken at the school level from standard 3 to 8 in three-hour question papers or an additional twenty minutes in two-hour examinations. Students with any kind of disability will be entitled to an additional time of half an hour in three-hour question papers or twenty minutes in two-hour examinations in school written examinations, even if they write the answers in the written examination on their own and do not take the help of a scribe or even if they take the help of a scribe.
Cerebral Palsy (CP). Students with Intellectual Disability (external retardation), autism, learning disability, Parkinson's and multiple disabilities will be given an additional time of 15 minutes in addition to the above 30 minutes or 20 minutes.

Passing standard:

Even if the passing criteria in the assessment have been fixed in any other way, the passing standard for students with one or more disabilities of any kind shall be 20%. This passing standard shall be considered equivalent to the prescribed passing standard for a general student.

Physical facilities to be provided at the examination venue for students with disabilities:

  • In all school examinations, seating arrangements for students with disabilities shall be arranged on the ground floor.
  • Care shall be taken to ensure that furniture suitable for the disabled examinee such as ramps, benches, chairs, desks, tables etc. and accessible toilet facilities are available nearby.
  • For the purpose of supporting the disabled students during the examination, the responsibility should be assigned to the special teachers (such as IED, IEDS, Resource Teacher, etc.) working under the offices of Samagra Shiksha, Primary Education Director, Commissioner of Schools, etc. in each district.

Relaxation in the use of special equipment and materials during the examination

In all school examinations, disabled students will be allowed to use special equipment and materials as follows:

  • Completely visually impaired, low vision, blind, cerebral palsy (C.P.), autism, multiple disabilities, deaf and profoundly deaf, disabled students will be able to use computer screen-reader, computer with Braille loaded software, Abacus trailer frame, Bail mathematical compass if they wish.
  • Visually impaired students may use optical assistive devices such as magnifying glasses, talking calculators, large calculators, large keyboards, low-vision feet.
  • The class teacher and principal of the school shall have to give permission for the use of special educational aids and materials as per the reasonable needs of the individual student.

Question paper in Braille

If possible, decide to provide question paper in Braille to visually impaired students or arrange for a reader or writer.
As an alternative to question paper in Braille, the Principal shall make a copy of the original question paper available to the student in Word or any accessible e-format in his tablet/laptop/computer in accordance with the needs of visually impaired students in standards 6 to 8 in such a way that there is no violation of privacy.

Spelling etc. Errors

If there are spelling errors and incorrect syntax in English/other languages ​​in the evaluation of the examination of Divyang students, it should be considered forgivable and steps should be taken into account in the subject of Mathematics.

Reader/Writer Service Matters:

If students who are disabled or suffering from serious illness like fracture or muscle injury are unable to write for any reason and the students produce a certificate from a competent authority, the Principal will have to give permission for the service of Reader/Writer as per their need and reasonableness.
In standards 6 to 8, arrangements will have to be made with the help of special teachers so that they can answer the question paper by speaking through digital means as per the need of the visually impaired student. After the examination time is over, that audio file will have to be considered as the answer book.

Relaxation in Subject Selection

According to the disability of the disabled students and as per the requirement, exemption and relaxation will be available in the subject selection in the written examination. If the student wants, he/she will be able to get exemption from only one of the languages ​​other than the first language (mother tongue) i.e. the higher level language.
Apart from this, if the student wants to get exemption according to his disability in subjects like painting, health and physical education, music, the school principal can give exemption or alternative.

Inclusion of alternative questions

If the disabled students are facing any kind of difficulty in answering the questions in the question paper, they will have to be exempted from answering that type of question, such as, if the answer is to be given on the basis of a figure or picture, if the answer is to be drawn in a figure or picture, if the answer is to be completed in a map, then an alternative question for the disabled student will have to be given in the question paper instead of that type of question. If an alternative question is not given in the question paper, then the school principal can give an alternative question in place of that question.

Evaluation in Foundation Stage:

There is no formal written examination in Nursery, Grade-1 and Grade-3, but it should be kept in mind that informal evaluation is also flexible for students with disabilities. The teacher will have to evaluate the student based on his/her own understanding based on the type of disability.

For students with Intellectual Disability, the following evaluation arrangements will have to be made instead of the normal question paper.

  • In both the sessions, a total of 100 marks will be assessed, i.e. 25 marks oral, 25 marks practical, 50 marks written examination.
  • In Nursery and Grades 1 to 5, more emphasis will be given to oral examination and practical examination. Written evaluation will have to include objective questions like MCQ, blank space, pairs, comparative questions.
  • In Grades 6 to 8, more emphasis will be given to oral examination and practical examination. In the written examination, objective questions and short answer questions such as one-two sentence answers will be asked.
  • The question papers in this regard will have to be prepared by the principal of the school.
Separate examination/online examination facility will have to be provided to home-based or bedridden children at their residence. The decision of which will have to be taken by the District Education Officer/District Primary Education Officer/Administrative Officer of the respective district for the school under his control.
During the examination, the instructions given from time to time for the differently abled students will have to be taken into consideration.
